There is significant controversy about whether the 2004 presidential election was conducted fairly and its votes counted correctly. According to results of the major national election exit poll conducted for the National Election Pool by Edison/Mitofsky (E/M), Kerry won Ohio's pivotal vote, though the official tally gave the state, and thus the presidency, to Bush. The conduct of Ohio's election was formally debated by Congress in January 2005.

What in the World is Interpreted Code and What’s Wrong With It Anyway?

Earlier this month Leon County, Florida Supervisor of Elections Ion Sancho, invited computer experts to demonstrate the existence of a security flaw in Diebold optical scanners described in a report published on July 4, 2005.  The test was repeated in December in order to refute specific denials by Diebold. In statements to two different election officials Diebold claimed it was not possible to alter the outcome of an election in such a way that the perpetrator would not need passwords and the tampering would not be noticed during normal canvassing procedures.  Sancho set up the test environment on December 13, 2005 to prove these claims false.  The outside experts had no access to the optical scanner and the complete canvassing procedure was followed for 8 test ballots.  The result was that while the 8 paper ballots had a vote tally of 2 Yes and 6 No, all of the official reports - from the optical scanner on through to the publication of county results - showed an outcome of 7 Yes and 1 No.

Jan. 3, 2006: Information received pointing to similar vulnerabilities in the ES&S and Sequoia "Optech" optical scan machines.

In an exclusive interview by BBV investigator Jim March with Dr. Douglas Jones, University of Iowa associate professor and a former voting machine examiner for the state of Iowa, it was learned that one of the most widely-used voting machines over the last 15 years may suffer from design flaws broadly similar to Diebold's version 1.94 and 1.96 optical scan system.

The first problem is that memory chip contents can be modified with easy to obtain reprogramming devices, in ways that could enable Hursti-style hacking.

At issue: A YES-NO question: Do Diebold touch-screens have a problem similar to that identified in the Black Box Voting project in Leon County, Florida -- the devastating hack of the Diebold optical scan system. Just a YES-NO question.

Black Box Voting has now obtained certain NEW specific information indicating that the answer with the touch-screens will be ?YES.? One of our researchers has identified an interpreter, which appears to be specifically prohibited by 2002 FEC standards, inside a Diebold touchscreen system.

What is needed now is to confirm this finding with a "pedigreed" Diebold touch-screen system ? ie., one to which we are given legitimate access with one of our publicly known experts. We will have to show that what our protected source has found is also present in a system delivered by Diebold for use in actual elections. This cannot be a stolen system, a specially souped-up system (i.e. one that Diebold chooses), or a system used without authorization of its custodians.

Dear Elections Assistance Commission

Today I write to express my disappointment with the non-responsiveness of the commission to the needs of the voters. You do well when it comes to the needs of the voting machine vendors, it seems, but the voters are being ignored.

You say that "the Commission serves as a national clearinghouse and resource for information and review of procedures with respect to the administration of Federal elections". I'm sorry to say that you fail as both a national clearinghouse and as a resource for information.

The county famous for its ironic phrase: "Vote early, vote often" may have to look for a new tag line this year.

Cook County Clerk David Orr, who spoke to Palatine Township residents, is confident the security and uses of the county's new electronic voting machines will preserve the integrity of the election process.

"Cook County has the longest and most complicated ballots in the nation," Orr said. "Probably because we have all sorts of different units of government and retention of judges."

Two people living next door to each other might have different state representatives, live in different park districts, or have different school districts, Orr said, so there are multiple ballot styles -- as many as eight or nine in one precinct.

Orr said electronic vote machines would cut down the complexity of knowing which voter gets which ballot style.

Due to contractual non-performance and security design issues, Leon County (Florida) supervisor of elections Ion Sancho told Black Box Voting that he will never again use Diebold in an election. He has requested funds to replace the Diebold system from the county. He will issue a formal announcement to this effect shortly.

Finnish security expert Harri Hursti proved that Diebold lied to Secretaries of State across the nation when Diebold claimed votes could not be changed on the memory card.

A test election was run in Leon County today with a total of eight ballots - six ballots voted "no" on a ballot question as to whether Diebold voting machines can be hacked or not. Two ballots, cast by Dr. Herbert Thompson and by Harri Hursti voted "yes" indicating a belief that the Diebold machines could be hacked.

At the beginning of the test election the memory card programmed by Harri Hursti was inserted into an Optical Scan Diebold voting machine. A "zero report" was run indicating zero votes on the memory card. In fact, however, Hursti had pre-loaded the memory card with plus and minus votes.
